| An uncontested matter is when two people have reached an agreement on all issues dividing their assets and debts as well as how custody, parenting time and support should work between them. Under these circumstances, the parties want to keep their legal costs and involvement in the legal system to a minimum. The process is relatively simple in the state of Kansas. After the client completes a short intake form, our office prepares and files the Petition asking for a divorce or annulment. We then prepare the final decree which incorporates the agreement of the parties. Once the paperwork has been signed by both parties, we obtain the Judge's approval and file it at the Courthouse. The waiting period in Kansas, to finalize a divorce, is 60 days. Under some circumstances, the parties may wish to finalize the divorce sooner. This can be accomplished by requesting an emergency divorce. It is not necessary for either party to get a letter from their doctor to proceed on an emergency basis as long as both parties agree to it. We will take care of obtaining the Judge's approval for an emergency divorce. Normally an emergency divorce can be finalized the next business day after both parties have signed and returned all the paperwork to my office. There is no waiting period in Kansas to finalize an annulment. Like an emergency divorce, the annulment can be finalized the next business day after both parties have signed and returned all the paperwork to my office. Under these circumstances, it is not necessary for a summons to be served on either party, there are no temporary restraining or support orders issued, and neither party is required to come to court for a formal court appearance. Due to ethical concerns regarding conflict of interest, our office can only represent one of the parties. It is not required that the other party retain an attorney to represent them. They may wish to consult with another attorney to review the decree before signing it but that is not required. We can assist you in determining child support payments under the Kansas Guidelines.
