DIVORCE
OR ANNULMENT

Kansas residents - from any part of the state - may file for uncontested divorce or annulment through this website if both you and your spouse have reached an agreement regarding all issues.

2.  Contact legal assistant Laurie Showell at (316) 263-8844 or laurie@molamphylaw.com to schedule an appointment to draft and sign the necessary documents for your uncontested divorce or annulment.  Or, if you are not in the Wichita area, we will make arrangements to send your documents to you for review and signature.  In most cases, you will not need to come to our office, depending on the facts in your case.

For divorces, the state of Kansas has a 60 day waiting period between the filing of the Petition and finalizing of the divorce. There are circumstances where the parties may wish to finalize the divorce sooner than 60 days, such as a party’s military status, pending real estate transactions, concerns about debts or other financial considerations including income tax filing status, or just for closure.  This office can generally obtain an emergency divorce under any of these circumstances as long as both parties will sign the divorce decree.  Normally an emergency divorce can be finalized the next business day after both parties have signed and returned the paperwork to this office.

The state of Kansas has no waiting period to finalize an annulment.  Like an emergency divorce, the annulment can be finalized the next business day after both parties have signed and returned the paperwork to this office.

In an uncontested matter it is usually not necessary for a summons to be served on either party, there are no temporary restraining or support orders issued, and neither party is required to come to court for a formal court appearance.

However, if the other party will not sign the decree, then this office will have the Sheriff or a court appointed Special Process Server serve the Petition on the other party.  If the other party takes no action to contest the divorce or annulment, then the unopposed decree can be approved by the Judge and filed at the Courthouse after the appropriate waiting period has passed.

If the other party cannot be found, then service can be obtained by publication and if the other party takes no action to contest the divorce or annulment after the notice is published, then the unopposed decree can be approved by the Judge and filed at the Courthouse after the appropriate waiting period has passed.

Due to ethical concerns regarding conflict of interest, our office can only represent one of the parties.  It is not required that the other party retain an attorney to represent them. They may wish to consult another attorney to review the decree before signing it, but that is not required.

Child support can be agreed upon by the parties and it is not required that child support be based on the Kansas Child Support Guidelines, if you agree otherwise.  However, if you wish, we can assist you in determining the amount of child support that would be indicated by the Kansas Guidelines.  See our Child Support page for more information.
